When is Operating Authority Required? Flow Chart Outline Description

Title: When is Operating Authority Required?

Top of chart begins “Start” and then Q: “Is the carrier involved in Interstate commerce?*”

  1. If “No”, then “Not Required”.
  2. If “Yes”, then Q: “Is the Carrier hauling their own product?”
    1. If “Yes”, then “Not Required”.
    2. If “No”, then Q: “Is the load an exempt commodity?**”
      1. If “Yes”, then “Not Required”.
      2. If “No”, then “Required. If carrier does not have operating authority, place vehicle out of service.”

*Interstate commerce is defined by the intent of the shipment. If the intent of the shipment is to leave the state directly, or as part of a shipment which is going out of the state or coming into the state, it is considered INTERSTATE commerce.
