Small Wireless Facilities (5G)
Overview and Background:
During the 2018 legislative session, S.B.189 was passed to create the Small Wireless Facilities Deployment Act. This new law authorizes telecommunications companies to obtain permits to install Small Wireless Facilities (SWF) in the UDOT right-of-way. Utah Code Ann. § 54-21 outlines the specifications, restrictions, and permit application process for wireless providers to apply for and obtain a permit for a SWF in the UDOT right-of-way. This is an important part of building a strong telecommunications infrastructure in Utah.
Application Process:
UDOT is committed to providing applicants with a streamlined application and approval process. Applications and approvals are processed using the Online Permit System. Applicants will be able to submit information, upload documents and pay applicable fees using the SWF portal on the Online Permit System. Small Wireless Facility Permit Fees and Rates:
- Non-refundable $100.00 application review fee for each SWF collocated on an existing or replacement utility pole
- Non-refundable $250.00 application review fee to install, modify or replace a utility pole associated with an SWF
- The annual rate of $250.00 for each SWF for the right to use or occupy the right-of-way
- The annual rate of $50.00 for each SWF collocated on UDOT’s approved utility poles
The Legal Agreements Process:
The legal agreements must be approved before beginning the SWF Permit Process.
Completing the agreements process in a timely manner is almost entirely based on the applicant. UDOT is committed to making every effort to respond to legal agreements requests within 7-10 business days after receiving a signed copy from the applicant. To ensure statewide processing consistency and efficiency, the standardized agreements cannot be modified or changed. Please email smallwireless5g@utah.gov to begin this process.
